Enforcement Proceedings

Patents are normally enforced through the Courts, but there are some opportunities for less expensive proceedings involving the Patent Office.

In the UK there are two Court systems available for enforcing patent rights: the Patents (High) Court and the Patents County Court.  Detailed rules determine which Court system may be used.  The differences between the two systems are not as great as they once were.  Normally it is the more complex and commercially significant cases which use the High Court system.

Patent Court proceedings are often very expensive.  The possibility does exist to take Patent Legal Expenses Insurance.
